Past Successes
o The Freedom of Health Foundation’s mission is twofold: to fight for freedom of choice in the medical marketplace and to spread the word about nutritional supplements and other safe, effective natural therapies. Whenever the US or state governments, unelected bureaucrats, or the pharmaceutical industry attempts to deny access to these treatments or suppress the truth, we will combat them by educating and mobilizing concerned citizens. Together, we can make a difference. Here are some of the highlights of our efforts. To read more about each of these, click on the links below.
- FDA Busted!
For decades, the FDA forbade manufacturers from putting useful information on supplement labels, telling consumers what the products were for and how they might improve their health. In 1999, the FDA’s long-entrenched actions were ruled unlawful and unconstitutional by a US Court of Appeals that concluded, [The] First Amendment directs us to be especially skeptical of regulations that seek to keep people in the dark for what the government perceives to be their own good. Our donations helped keep this eight-year legal battle alive.
- A Victory for Freedom of Speech
Two years after the FDA was soundly spanked by the courts for their unconstitutional refusal to allow truthful and nonmisleading claims on nutritional supplement labels – and another lawsuit – we won the right for supplement manufacturers to state on product labels that folic acid, vitamin B6 and vitamin B12 may reduce the risk of vascular disease.
- A Big Win in the U.S. Supreme Court
When compounding pharmacies sued to be allowed to distribute promotional materials informing patients and physicians of the uses and effectiveness of specific compounded drugs, I filed an amicus curiae in the successful Supreme Court case of Thompson v. Western States Medical Center. The Court found that the government’s restrictions were excessive, establishing commercial speech rights for compounding pharmacists under the First Amendment.
- The Public Must Be Warned of Statin Drug Dangers
I have filed a Citizen Petition with the FDA to ask that a warning be placed on all statin drugs detailing the adverse health consequences of statin-induced CoQ10 deficiencies and how to avoid them. The FDA continues to sit on it, and millions have been harmed as a result.
- The Stevia Saga
Stevia is a safe, natural, herbal sweetener that was arbitrarily and illegally banned in 1991 by the FDA an “unsafe food additive.” Our pressure on the FDA helped bring stevia back in 1995.
- A 20th Century Book Burning
Overzealous FDA agents actually threatened to burn books on stevia that a small Texas company sent out with stevia orders, claiming the books constituted “nutritional labeling.” I unleashed my attorney on them, and within days the FDA backed down.
- A Guns-Drawn Office Raid
After the FDA in a guns-drawn raid terrorized patients and staff and seized computers, medical records, and nutritional products from Jonathan Wright, MD, in Kent, Washington, we bombarded the FDA commissioner with letters of outrage. Dr. Wright was never charged, and his possessions were eventually returned.
- Illegal Confiscation of a Nutritional Supplement
When retired schoolteacher Paul Gallo went to the post office to pick up a bottle of DHEA, which he had legally imported from Europe, he was arrested by the Bergen County New Jersey Narcotics Task Force. Our letters pressured the New Jersey attorney general to drop the charges, and Mr. Gallo got his DHEA.
- A Family's Fight for Medical Freedom
I funded a suit by David Smith, who had Stage IV metastatic Hodgkin’s Disease, to force the FDA to allow Mr. Smith access to antineoplaston therapy. David received treatment for about two months with significant improvement, when the FDA ordered the Burzynski Clinic to stop, imploring David to undergo chemotherapy instead. David refused, and the FDA held firm, in effect handing him a death sentence. The court declined to grant an injunction against the FDA, so David was forced to leave the country to receive treatment.
- A Modern-Day Witch Hunt
The National Council Against Health Fraud (NCAHF) is a non-profit, tax-exempt organization whose purpose is to "educate consumers, professionals, business people, legislators, law enforcement personnel, organizations and agencies about health fraud, misinformation, and quackery." This organization has slandered hundreds of reputable physicians and researchers, including Nobel laureate Linus Pauling, Ph.D., and has brought legal action against some of them. We’ve revealed this organization for what it is: a group of intolerant, uninformed zealots bent on destroying alternative medicine.
